What is the difference between nursing home abuse and neglect?

This blog has previously discussed the signs and symptoms one can look for that may be indicative of the abuse of a loved one who is in a long-term care facility or nursing home. While lay persons often use the words 'abuse' and 'neglect' interchangeably in such instances, as with many words, the terms have separate meanings in a legal context. Further, there is a third term, 'exploitation,' that also is reportable to the Connecticut Department of Social Services, and might be actionable in court.

Human trafficking

The crisis of sex trafficking of children has become epidemic in the U.S. and we find it right here in our state where the police were able to rescue a young girl in Milford, CT. Victims like this young girl will require a lot of supportive care. Pimps use the Internet to attract their victims. In fact the Internet has been called the crime scene of the 21st century.

Sexual Abuse Scandal at Rhode Island Boarding School

The St. Georges School of Middletown Rhode Island is being accused of not protecting boarding school students in the 1980s from sexual assault by other students or teachers. Many Connecticut residents have attended the prestigious boarding school. To date, over 40 victims have come forward and many more are expected. Tremont Sheldon Robinson Mahoney continues the fight for all sexual abuse victims including those at schools, medical facilities, and religious institutions.

Everyone's favourite teacher' violated state code of ethics in sex assault case

People need to know that state and district policies forbid teachers from spending alone time with students off site. The Bethel school board needs to do a better job enforcing these policies including making teachers and students aware of them.

Stamford High School Scandal

Once again we see a situation where a school board has failed to protect students. Even after receiving notification of inappropriate sexual contact between a Stamford High teen and his teacher, nothing was done. School boards have to be vigilant. It's not enough to have policies; school boards have a duty to enforce these policies instead of taking a "see no evil, hear no evil" approach.

What is negligence in Connecticut premises liability?

Previously, this blog discussed the fact that Connecticut residents who find themselves injured by a dangerous condition while on someone else's property may have a claim for compensation. It was also touched on that it is usually the negligence of the property owner or person responsible for managing the property that gives rise to such a claim. But what exactly is 'negligence' and how would one know if any occurred in relation to a premises liability accident?

Sexual abuse suit; CT school and then-headmaster under scrutiny

When a victim of abuse comes forward, those accused of the crime not only face criminal charges but could also endure civil actions. Victims of sexual abuse are able to hold a perpetrator accountable for the crimes committed and the damages they caused to the victim.

Victims injured by drunk driver can hold serving bar responsible

Everyone knows that when a driver chooses to get behind the wheel of his or her vehicle after having too much to drink, it is a mistake. However, these things still happen despite the fact that drunk driving is a 100 percent preventable decision. Obviously, a large percentage of fault lies with the intoxicated driver following an accident. However, did you know that if the intoxicated driver that caused a car accident was over served at a bar or restaurant, that establishment could share a portion of the liability?

You still have rights when car accidents happen in winter weather

We all know that driving is more dangerous in bad weather. Road conditions deteriorate, visibility decreases, traffic may stop and start, and vehicle performance is affected. Drivers must be at their best in rain, snow and ice. Unfortunately, many people fail to adjust their driving to dangerous weather conditions.
