Once Your Case Is Resolved…

When we reach a settlement, you, as the plaintiff, will be required to sign a Release of All Claims. This means that in exchange for a monetary settlement, you give up your right to pursue a claim against the defendant. If a lawsuit has already been filed, you will be required to withdraw the case from court. The release and withdrawal will be provided either to the insurance company and/or to defense counsel. Under state law, once the required settlement documents are provided, the insurance company has 30 days to provide us the settlement check. You will soon thereafter receive your check along with your settlement statement, which will provide details of the disbursements paid in your case. Settlements for most personal injury cases are tax-free.

Please refer to the overview of the life cycle of a case.

  • After a settlement is reached, you will be required to sign a Release of All Claims, which means you can no longer pursue a claim against the defendant.
  • After the documents are signed, the insurance company has 30 days to provide us the settlement check.
  • Soon afterward you will receive your check and settlement statement explaining the details of disbursements paid in your case.
  • Settlements for most personal injury cases are tax-free.
