Tremont Sheldon P.C. Wins Largest Verdict in Connecticut History for a Motorcycle Accident Case – $2.1 Million

Tremont Sheldon P.C. won the largest verdict in Connecticut history for a motorcycle injury. The total recovery for our client was $2.1 million.

It all began on Halloween night in 1997. Our client, Kevin, was 43 years old and worked as a mechanic for the Town of Brookfield Parks Department. Due to the nature of his injuries, Kevin does not recall what happened after he left work that day. By all accounts, he stopped at a local tavern where he met his coworkers and had one or two beers. He then went to the supermarket to do some shopping for dinner. Around 6 p.m. he rode his motorcycle home from the supermarket. As Kevin approached the entrance to the Housatonic Area Regional Transit District bus yard, a bus that was coming from the opposite direction suddenly made a left-hand turn in front of him, cutting him off and causing Kevin to strike the folding bus doors. The force of the impact caused the doors to explode and threw Kevin off his bike.

Kevin’s injuries were extremely grave and he nearly died. Kevin suffered two primary injuries: a traumatic brain injury and a severe fracture of his left arm, which required emergency surgery to put it back in place. He also suffered rib fractures, a fractured scapula, and numerous facial lacerations. Kevin had to be hospitalized for almost two months and required over a year of intensive therapy. Due to the extent of his injuries, Kevin has never been able to return to work.

Kevin knew that he needed a lawyer, but he did not know where to turn. He decided to hire a “TV lawyer” who appeared in commercials that Kevin watched while he lay in his hospital bed. Kevin figured that the lawyer had to be good if he could afford all of those TV spots! Unfortunately, although the lawyer was eager to visit Kevin in the hospital to sign him up as a client, that was about all he did.

The insurance company for the bus company blamed Kevin for the accident, claiming that he was speeding and drunk, all things that were not true. Kevin’s “TV lawyer” was no match for the insurance company’s tricks. Kevin called the lawyer on numerous occasions to discuss his case, but the lawyer failed to return his calls. Finally, Kevin went to the lawyer’s office and demanded to know what was going on. The “TV lawyer” told Kevin that his case would have to go on the “back burner” because of his busy schedule.

Kevin was devastated and did not know what to do. Fortunately, one day as he walked along his street, he struck up a conversation with a former client of Tremont Sheldon P.C. and told her his tale. She immediately sent him to us for help.

“I was shocked when I heard how Kevin was treated and we immediately began to do what we had to do to help him,” says Attorney Bob Sheldon. Attorneys Sheldon put together the evidence to prove Kevin’s case. First they hired a man who was the former chief accident investigator for the Philadelphia Police Department to reconstruct the accident and prove that it was not Kevin’s fault. They also put together Kevin’s medical picture and arranged for the emergency room surgeon, his orthopedist, and his neurologist to come into court to testify as to his injuries. They also sent him for an evaluation by a neuropsychologist at Yale to evaluate his brain function. “We owed it to Kevin to use whatever resources we had to prove his case,” said Attorney.

Over a three-week period, Attorney Sheldon tried Kevin’s case before a jury in Danbury. After deliberating for eight hours, the jury found the bus company to be 100% at fault for the accident and awarded Kevin, with interest, over $2 million. “I am very grateful for everybody’s efforts at Tremont Sheldon P.C. on my behalf. Nobody believed in me until I met them,” said Kevin.
