$2.25 million for Fall Down Apartment Stairs
Our client, Bill, was a mason who was forced to stop working because of progressively severe left knee pain, and he underwent left total knee replacement surgery. Shortly before his surgery, Bill leased an apartment in a multi-family dwelling, and the owner promised Bill that he would repair the deteriorating rear exterior concrete stairway, which was the only means of access to Bill’s apartment, but the owner never made those repairs. The tread surface of one of the stairs failed and broke, which caused Bill to fall and suffer serious injuries to his left knee and resulted in multiple hospital stays and complications from his injuries. Bill brought a claim against the homeowner for loss of future earnings since he was unable to work after the fall, but prior to trial, the parties agreed to mediate the case with a respected local trial attorney. Through his skillful efforts, after a lengthy mediation process, the parties agreed to settle the case for $2,250,000.
